In the battle between Apple and Amazon over the use of the term Appstore it seems that a U.S. judge has ruled supreme over them. Amazon using the term App Store is fine by him.
The saga first started as Amazon launched it’s android application market and named it the ‘App store’. the same name which Apple had been using to push it’s mobile applications as well. Apple took offense and according to BGR argued that Amazon’s ‘Appstore’ infringed on Apple’s ‘App Store’ trademark. Amazon called the claim baseless and well, the court has now sided with them Judge Phyllis Hamilton went on to say âThe evidence does show that Apple has spent a great deal of money on advertising and publicity, and has sold/provided/furnished a large number of apps from its App Store.However, there is also evidence that the term âapp storeâ is used by other companies as a descriptive term for a place to obtain software applications for mobile devices.â He also said that the term ‘App Store’ was more “Descriptive than distinctive” Apple has now taken the case to an appeals board.
